Erik and Lyle Menendez's lawyer reveals whether they have a plan if they get out of prison

As Lyle And Erik MenendezWith the upcoming new hearing, do the brothers have concrete plans for the possibility of their release from prison?

Your lawyer Mark Geragos spoke with Us weekly and other reporters said at a Menéndez family press conference on Wednesday, Oct. 16, “I'm not going to talk about whether (Erik and Lyle) have a plan.” I just think you have to ground yourself in order to cope every day survive.”

Geragos noted that Lyle, 56, and Erik, 53, were aware of how difficult the transition would be for them, adding, “It's a long road from life without (parole) for almost 17 years to Hope.”

Erik and Lyle's legal counsel further clarified whether they expect a new trial or the siblings' release.

“We originally requested that the conviction be overturned. That's what a writ of habeas corpus is. The other component of this is resentment. So it’s two tracks,” Geragos explained. “You can pause the habeas corpus while you consider resentencing. So it’s running and chewing gum at the same time.”

He continued: “If habeas were granted, you would get a new trial. If they are resentenced, under California law the judge has the option to recall the conviction and sentence them with a variety of options.”

Geragos expressed optimism about the outcome of the hearing, scheduled for Tuesday, Nov. 26.

“We may release it tomorrow, but part of the mitigation package that we presented to the Los Angeles district attorney are letters from corrections officials – high-ranking corrections officials – testifying to the phenomenal rehabilitation,” he revealed. “We have a number of correctional officers who have actually said that if Erik and Lyle are released, they should be released and that they would welcome them as neighbors.”

Erik and Lyle were originally arrested in 1990 on two counts of first-degree murder after their parents, Jose And Kitty Menendez, were found dead in their own home. Two consecutive trials resulted in Erik and Lyle's convictions and life sentences without the possibility of parole. The brothers, meanwhile, have claimed that their mother and father were physically, emotionally and sexually abusive and that their actions were in self-defense.

The murder case has since garnered renewed attention after Lyle and Erik received public support from the reality star Kim Kardashian. Her experience was also dramatized Ryan Murphyis the Netflix series Monsters, in which Nicholas Alexander Chavez brought Lyle to life while Erik was played by him Cooper Koch. Meanwhile, José and Kitty were portrayed by Javier Bardem And Chloe Sevignyrespectively.

Murphy has since pointed out how his show has sparked new interest in Erik and Lyle – despite her disapproval of their portrayal.

“They are now discussed by millions of people around the world. A documentary about her will be released in two weeks, also on Netflix. And I think the interesting thing about this is that people have to answer the questions: “Should they get a new study?” Should they be released from prison? What is happening in our society? Should people be locked up for life? Is there ever a chance of rehabilitation?'” he told Variety in September. “It interests me and a lot of people talk about it. We're asking really tough questions and giving these brothers another trial in the court of public opinion. From what I can tell, it really opened up the possibility that this evidence that they say they have might provide a path forward for them.”

Erik and Lyle received a new hearing for their case a month later after the Los Angeles District Attorney's Office presented new evidence, including a newly discovered letter Erik had written to his cousin Andy Cano describes his father's alleged sexual abuse months before the murders and singer Roy Rossello's allegations against José.
