Sister says Nima Momeni was “calm” after telling him she took too many drugs and slapped her bottom

The sister of accused murderer Nima Momeni told a jury on Monday that her sister was “very calm and collected” after telling him she woke up in a drug-induced daze and was murdered by a suspected drug dealer over the Cash App -Founder Bob was hit on the ass by Lee.

Khazar Momeni's testimony during questioning by the prosecution could help the defense prove its theory that the defendant was not the attacker. Instead, Nima Momeni's lawyers argued that Lee was armed with a knife and chased her client, who grabbed the knife and killed Lee in self-defense.

Khazar Momeni returned to court in San Francisco for the second day of her brother's murder trial.

On the witness stand, she told jurors that she had taken a number of drugs, including GHB and nitrous oxide, the night Lee was killed. She said she and a friend ended up “face down” at a party and she remembered Lee's alleged drug dealer slapping her on the butt. She called him a predator.

“I didn’t know what country I was in,” she said, adding, “I was scared and cried like I’d never cried before.”

She said she asked her brother to pick her up, saying her sibling was a protective older brother and was calm after she told him what happened.

This contrasts with the testimony of a friend of Lee's who said that in a phone call with Lee, Nima Momeni sounded angry and accusatory and demanded to know what drugs Khazar Momeni had been given.

The sister admitted on the witness stand Monday that she was also under the influence of drugs for a week after Lee's murder.

KTVU legal analyst Michael Cardoza said the jury will have to carefully consider their testimony.

“Basically, she treated her body like a carnival. You know, let me take all these drugs. So the jury has to decide. 'Do we believe her? Is her memory good?' Because she apparently took all of these drugs voluntarily. So the jury has to decide again: Who is a better witness?”

The defense will cross-examine the sister on Tuesday.
