Gina Carano is one step closer to forcing Disney to put her back in The Mandalorian

It may have seemed like a long-reaching lawsuit at first, but the Elon Musk-backed “free speech” case between Gina Carano and Disney doesn't exactly resolve, and it keeps coming back in the actress's favor.

Carano was fired in 2021 after a series of controversial comments on social media, ranging from anti-trans rhetoric to saying that conservatives were being persecuted like Jews during World War II. However, she believes Disney had no real reason to fire her given the nature of her contract, and she claims gender discrimination was grounds for firing because her male co-stars did not respond to her “personal political beliefs “have been checked.”

Now a court had rejected a request to allow Disney to put the case on hold after rejecting the previous request to dismiss. This time the court ruled that Disney cannot request a stay of proceedings or an interim appeal. In short, this Is stand trial, but not until September 29, 2025.

Unable to get the case out of control, Disney fought back in other ways, although none of them seemed to work. This doesn't necessarily mean that they would lose the case itself, but rather that their initial tactics won't work here. Carano made a triumphant statement on social media following the decision:

“I’m obviously very excited about the opportunity to move the litigation forward and move forward with disclosure,” Carano said. “Although I wish this were not necessary, as it is not my desire to take part in this battle in court, I will not shy away from it because it is hard or unpleasant.”

Carano is seeking damages over the situation but, surprisingly, is seeking an injunction that would allow her to return to work and force Disney to rehire her for the role of Cara Dune in The Mandalorian, where she had a supporting role . Before all of this, she also seemed to be on the verge of getting her own spin-off.

Of course, this seems like the most absurd part of the case, since Carano forcing Disney to hire again would result in what exactly? What are the rules for something like this? Could they rehire her and have her fall into a Sarlaac pit in the first few minutes of her appearance? Would the injunction dictate the length of her playing time? This seems almost impossible to consider. And it's not even clear that The Mandalorian is coming back for another season after the upcoming Mandalorian and Grogu movie. Could she force them to put her in there? This part of the whole thing still seems to have the most reach. Damages would be more likely if she won.

From a legal perspective, it is unclear what is actually happening here, but the courts are taking the matter seriously and it will be heard within a year. It should at least be interesting, but it would be something of a miracle if we actually saw Cara Dune on screen again.
