Here's how Elon Musk's  million a day donation to battleground voters works

Tech billionaire Elon Musk is making a splash in the Pennsylvania campaign to help former President Donald Trump's re-election by, among other things, offering $1 million a day to swing state voters who support his political action committee's petition sign in support of the constitution.

“Every day from now until November 5th, @America PAC will be giving away $1 million to someone in swing states who signs our petition in support of free speech and the right to bear arms! “We want to make sure everyone in the swing states hears about it and I suspect this will make sure they do,” Musk, the richest person in the US, posted on X early Sunday morning.

The night before, during an event in Harrisburg, Pennsylvania, Musk granted a sum of $1 million to a Pennsylvania man named John Dreher.

“The only thing we ask for the million dollars is that you be a speaker on the petition, and that’s really it,” Musk said at the rally, as Dreher explained he “had no idea” he was chosen .

Fox News examined the legality of the initiative and found that it is a legal gray area that appears to be open to interpretation, and also noted similar Democratic initiatives in the Keystone State and nationally.

Under federal law, paying someone to register as a voter is a crime. However, Musk's giveaway doesn't entice voters to register, but instead to sign a petition.

Musk's rules surrounding the $1 million award include that voters sign his PAC's petition supporting the First and Second Amendments of the U.S. Constitution. The initiative outlines that it applies only to registered voters in the battleground states of Pennsylvania, Georgia, Nevada, Arizona, Wisconsin and North Carolina, meaning unregistered voters are not eligible for the program.

“The First and Second Amendments guarantee freedom of speech and the right to bear arms. By signing, I pledge my support for the First and Second Amendments,” the petition reads.

America PAC's website states that one petition signer from the Pittsburgh area will receive the Oct. 20 total and another signer from Pennsylvania will receive the Oct. 21 total.

“22. October – November 5: Every day a petition signer from PA, GA, NV, AZ, MI, WI or NC will earn $1,000,000,” the website continues, detailing which states are considered battlegrounds.

The petition does not require a resident to register to sign the petition, but simply asks users to respond as to whether they are registered voters.

The Washington Post reported earlier this month in an article titled “Massive influx of shady campaign spending floods swing states” that a nonprofit in Philadelphia mailed more than 100,000 comic books to voters under 32 in 2017. The area is said to have Increase voter turnout in favor of Vice President Kamala Harris. The outlet explained that the nonprofit has also “tried to encourage voting” this cycle by offering $1,000 Target gift cards, $2,000 rent checks and $10,000 grants -Dollars given to community groups.

A youth-focused nonprofit, The Civic Center, is running a similar promotion for high school students: $150 gift cards for students to help prepare their schools for High School Voter Registration Week.

The $1 million-a-day donation amid a close and highly anticipated election has drawn some criticism and legal concerns from Democrats, including Pennsylvania Gov. Josh Shapiro, who previously served as attorney general.

“I think there are real questions about how he is spending money in this race, how the dark money is flowing not only into Pennsylvania but apparently now into the pockets of Pennsylvanians. “This is deeply concerning,” Shapiro said on NBC’s “Meet.” the press.”

He continued: “Look, Musk obviously has the right to express his views and he has made it very, very clear that he supports Donald Trump and we have different opinions. I don't deny him that right, but when you start pouring that kind of money into politics, I think it raises serious questions that maybe people should look at.”

“Do you think it might not be legal, yes or no?” asked host Kristen Welker.

Shapiro responded, “I think that's something law enforcement can look at.”

Musk brushed aside concerns about X: “Worrying that he would say something like that.”

Earlier this month, Musk's PAC announced that it would offer a starting wage of $30 an hour – well above the federal minimum wage of $7.25 an hour – to people seeking higher voter registration and turnout, the PAC said also offers embattled state voters $47 for every registered voter they vote for. The PAC, which describes itself as a promoter of “free speech, free markets and a meritocratic society,” was officially launched earlier this summer Federal Election Commission Filings from late last month show that America PAC has already invested at least $2.4 million in more than a dozen major congressional races. “Not just that he supported (Trump), but the fact that he's now becoming an active participant and showing up and doing rallies and things like that,” Fetterman told the New York Post this month.

“I mean, (Musk) is incredibly successful, and I think some people would see him as a Tony Stark,” Fetterman said. “Democrats, you know, kind of make light of it, or they make fun of him jumping up and down and things like that. And I would just say that they do that at our peril.”
